Making up “Shariah” laws out of thin air

Amazing how one particular Islamophobe thinks he can get away with this:

In Syriah[sic] Law, the living stand to inherit nothing from the dead Muslim spouse or kin. It seems to me the eldest son (is a Muslim) fabricated the story in order to be the sole heir of the deadman’s property[....]To think that a family receives nothing from their departed ones, the house, money and car, I’ll call this robbery. The eldest son or Baitulmal have no right to take everything from a family.

Indeed, he may have got away with it if he was trying to push this idea to someone else. (Un)fortunately in this case, he had to deal with me. While I am not claiming to be a Shariah law expert , I can spot a farce when it is clear that it is….well, a farce.

And this particular diatribe is certainly a prime example of how Islamophobes like to make up “Shariah” laws out of thin air to advance their bigotry.

  1. Actually, there is basis for this fear - a Hadith in the Muslim collection (Book 11, Hadith 3928), which states:

    “Usama b. Zaid reported Allah’s Messenger (may peace be upon him) as saying: A Muslim is not entitled to inherit from a non-Muslim, and a non-Muslim is not entitled to inherit from a Muslim.”

    While we have not consulted the Syariah enactments of Malaysia, a paper from the e-Syariah website - specifically, on page 3, article 7 (’Syarat-syarat Pusaka’) - states that a difference of religion is one criteria nullifying inheritance.

    Pulling things out of thin air? Guess again.

  3. How, by any stretch of the imagination, if the said hadith was indeed uttered by Prophet Muhammad, could it have referred to BORN MUSLIMS? In the Prophet’s time?

    Or is the first generation of MUSLIMS living in the time of the Prophet now conveniently thought of as BORN MUSLIMS?
